By installing or using the SeenByAI platform (available as a Shopify app and a standalone web application) ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Service.
These Terms constitute a legally binding agreement between you ("Merchant", "you") and Optima Solutions IT Limited, trading as SeenByAI ("SeenByAI", "we", "us"), registered in England and Wales with Companies House number 06927469, with registered office at Grammar School Street, Bradford, BD1 4NS, UK.
SeenByAI is a platform that measures your brand's visibility across AI search and knowledge models. It is available as a Shopify app and as a standalone web application. The Service queries real AI models, generates visibility scores, tracks competitors, and provides a personalized Playbook of recommended actions. When used as a Shopify app, the Service is read-only and does not modify your Shopify store or product data.
We reserve the right to modify, suspend or discontinue any aspect of the Service at any time, with reasonable notice where possible.
SeenByAI operates as a Shopify Partner application and is subject to Shopify's Partner Program Agreement and API Terms of Use. By using the Service, you also agree to comply with Shopify's terms where applicable. In the event of a conflict between these Terms and Shopify's terms, Shopify's terms will prevail in respect of your use of the Shopify platform.
This section applies only to users who access SeenByAI through the Shopify App Store. Standalone users are not subject to Shopify's terms.

You agree not to use the Service to:
Shopify users: Paid plans are billed monthly through Shopify's Billing API. All charges are processed by Shopify and subject to Shopify's payment terms. Subscription fees are non-refundable except where required by law.
Standalone users: Billing is processed monthly via Lemon Squeezy. The free tier requires no payment. Paid plans (Starter and Pro) can be canceled at any time through the Account page or the Lemon Squeezy customer portal.
We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
The Service, including all software, design, content and trademarks, is owned by Optima Solutions IT Limited (trading as SeenByAI) and is protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the Service as described herein.
Your store data, product content and any information you provide remains yours. You grant us a limited license to access and process it solely for the purpose of providing the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that specific results (including improvements to AI visibility scores) will be achieved.
AI models are operated by third parties and their behavior is outside our control. Scores and responses may vary between runs as AI models update their training data and search indexes.
To the fullest extent permitted by law, Optima Solutions IT Limited (trading as SeenByAI) shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, including loss of profits, data, or business opportunity.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to us in the three months preceding the claim.
Shopify users: You may terminate these Terms at any time by uninstalling the SeenByAI app from your Shopify store. We may suspend or terminate your access to the Service at any time if you breach these Terms or if required to do so by law or by Shopify.
Standalone users: You can delete your account and all associated data from the Account page at any time. Account deletion is permanent and removes all stored data within 30 days.
Upon termination, your right to use the Service will immediately cease and we will delete your data in accordance with our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
